CALEA (Communications Assistance for Law Enforcement Act )

Who Needs to File CALEA-Related Forms with the FCC? On December 14, 2006, the FCC released a Public Notice establishing filing deadlines for CALEA-mandated System Security and Integrity (SSI) and Monitoring Reports.  According to the Public Notice, "facilities-based broadband Internet access and interconnected VoIP service providers subject to CALEA must file," which means that exempt institutions are not required to submit these reports.  For those institutions that are subject to CALEA, the Monitoring report is due February 12, and the SSI report is due March 12.  You may find the following steps helpful in deciding whether or not you need to file:

1. The first step in this process is for your institution to decide whether it is subject to CALEA. This decision should be based on discussions with your legal counsel, your technical experts, and, if possible, your commercial provider.  The following documents may be helpful in making that decision:

   2. Thinking Through the CALEA Exempt/Non-Exempt Issue
   3. Letter from the Networking Policy Council
2. IF YOU ARE EXEMPT:  Do not file either the SSI Report or the Monitoring Report.  Document your decision process and include the names of those involved in case your decision is ever challenged.  It is not necessary or recommended that you notify the FCC of your exempt status.
3. IF YOU DETERMINE THAT YOU ARE SUBJECT TO CALEA:  You must file both the SSI Report and the Monitoring Report.
   1. The Monitoring Report is due February 12, 2007. Refer to the following documents for the form, instructions on how to fill out the form, and instructions on how to file the form:

   2. The SSI Report is due March 12, 2007. For your convenience, EDUCAUSE has provided a template for completing the report, some samples for your reference, and some additional documents as suggested background:
