State Approval Regulations for Distance Education: A ‘Starter’ List

Abstract
On October 29, 2010, the U.S. Department of Education (USDOE) released several new regulations, including the expectation that: "Under the Higher Education Act, for an institution in any State to be eligible to participate in Federal programs, it must be legally authorized by the State to provide postsecondary education." Institutions are expected to comply in each state in which they 'operate' by July 1, 2011. Institutions possessing proof that they are applying in a state will be considered in compliance for the 2011-2012 year.
