In cooperation with EDUCAUSE and NACUBO, the Natonal Association of College and University Attorneys (NACUA) will be hosting a virtual seminar, "Outsourcing Email and Other Institutional IT Services: Cloud Computing." NIST’s Technology Innovation Program (TIP) Advisory Board will hold a public meeting on December 8 in Gaithersburg, MD. TIP "supports, promotes, and accelerates innovation in the United States through high-risk, high-reward research in areas of critical national need." Additionally, the program supports "targeted investments in transformational R&D that will ensure our Nation’s future through sustained technological leadership."
November 30, 2009: NTIA and RUS Jointly Seeking Feedback on BIP and BTOP ProgramsCreated by Anna Gould (EDUCAUSE) on November 16, 2009
RUS and NTIA have released a joint request for information (RFI) regarding certain aspects of the Broadband Initiatives Program (BIP) and the Broadband Technology Opportunities Program (BTOP). This is the second joint RFI since both programs were established under the American Recovery and Reinvestment Act. Comments, which are due November 30, 2009, are supposed to “inform” the second round of broadband funding. Please see the EDUCAUSE Resource Center for more information on a National Broadband Policy.

The Federal Trade Commission has announced another extension of the enforcement of the "Red Flags" Rule. At the request of Members of Congress, the Federal Trade Commission is delaying enforcement of the “Red Flags” Rule until June 1, 2010. On October 29, the U.S. Department of Education issued the final regulations for the Higher Education Opportunity Act (HEOA). The Department had intially released proposed rules on August 21. Some sections of the HEOA relate to unauthorized file sharing, and these rules provide guidance on how colleges and universities comply with the law. October 22, 2009: FCC Issues Notice of Proposed Rulemaking Related to Net NeutralityCreated by Anna Gould (EDUCAUSE) on October 23, 2009
Yesterday, the FCC issued a lengthy Notice of Proposed Rulemaking (NPRM) relating to possible new network neutrality regulations. They are seeking public feedback on the Commission's "draft rules [for an] open Internet" through January 14, 2010. Reply comments will be due March 5, 2010.

As they hammer away at the National Broadband Plan (NBP), the Federal Communications Commission (FCC) is seeking comments regarding cybersecurity, public safety, and homeland security and how these elements may influence the NBP The commission hopes to better understand how "to implement and maintain a broadband infrastructure that is resilient in the face of cyber attacks and similar threats to network security." The Federal Trade Commission (FTC) has announced plans to hold a series of roundtable discussions relating to consumer privacy. The FTC is particularly interested in looking at the privacy challenges "posed by the vast array of 21st century technology and business practices," including: social networking, cloud computing, online behavioral advertising, mobile marketing, and the collection and use of information by retailers, data brokers, third-party applications, and other diverse businesses. As the Federal Communications Commission (FCC) works on the National Broadband Plan, some agency staff are taking a look at the possibilities of expanding telework. In order to learn more about how telework may play a role in the future, the FCC is seeking general feedback on already available programs. August 31, 2009/September 8, 2009: FCC Seeking Comments on Defining "Broadband" for National Broadband PlanCreated by Anna Gould (EDUCAUSE) on August 25, 2009
Since issuing their notice of inquiry for a National Broadband Plan in April, the Federal Communications Commission (FCC) has tried to promote open communications between the commission and stakeholders. After taking a look at the feedback they have gathered so far, the FCC is now seeking focused comments on specific subjects. The agency recently released a National Broadband Plan Public Notice #1, which seeks feedback on three different aspects of "broadband," including: 1) general form, characteristics, and performance indicators that should be included in a definition, 2) thresholds that should be assigned to these performance indicators, and 3) how the definition should be reevaluated over time. Comments are due to the FCC by August 31, 2009 and should be posted online. Reply comments (or responses to those comments already posted) will be due September 8.

The U.S. Department of Education has published a notice of proposed rulemaking (NPRM) relating to the Higher Education Opportunity Act (HEOA). The NPRM, which is featured in today's Federal Register, relates in part to the P2P (peer-to-peer) provisions that have garnered much attention in the EDUCAUSE community. In order to provide guidance on how to handle the H1N1 flu in colleges and universities, the U.S. Department of Education is holding a conference call tomorrow afternoon (Thursday, August 20, 2009) at 3 pm EDT. Education Secretary Duncan, as well as Health and Human Services Secretary Sebelius and CDC officials, will discuss ways the higher education community might prepare for and prevent the H1N1 flu. In today's Federal Register, the U.S. Department of Education has released a Notice of Proposed Rulemaking (NPRM) related to sections of the Higher Education Opportunity Act. The section related to rulemaking on distance education verification may be of particular interest to the EDUCAUSE community. The Department will be seeking public comments on this NPRM until September 8, 2009.

Featured guests include Department of Education Secretary Arne Duncan, Under Secretary Martha Kanter, and Deputy Under Secretary Robert Shireman. The group plans to focus on the Obama Administration's higher education agenda, and will allow for a Q&A session. The National Science Foundation's Office of Experimental Program to Stimulate Competitive Research has announced it is making grants available for the EPSCoR Research Infrastructure Improvement Program: Inter-Campus and Intra-Campus Cyber Connectivity (RII C2). The grant notice specifies that projects must comply with special reporting requirements and other non-standard terms and conditions mandated under the American Recovery and Reinvestment Act (ARRA), which is also known as the economic stimulus package. The National Telecommunications and Information Administration (NTIA) has announced that it is seeking volunteer panelists for reviewing grant proposals submitted under the Broadband Technology Opportunities Program (BTOP). Members of the EDUCAUSE and Internet2 community are encouraged to apply. Last week, the NTIA said it was collecting the first round of grant applications for the $4.7 billion program between July 14 and August 14, 2009. The agency says it plans to conduct panel reviews through "at least the end of September," and says the volunteer reviewers' contributions will "be an important factor ... in determining whether to award grant funding." Today the U.S. Departments of Agriculture and Commerce unveiled guidelines for the broadband grant program made possible by the economic stimulus. According to the official Notice of Funding Availability (NOFA), interested parties must submit completed applications between July 14 and August 14, 2009. The 120-page NOFA will ultimately be published in the Federal Register. This is expected to be the first of three rounds. The Internal Revenue Service has issued a Notice to request comments from the public regarding several proposals to simplify the procedures under which employers substantiate an employee’s business use of employer-provided cellular telephones or other similar telecommunications equipment (hereinafter collectively referred to as “cell phones”). April 20, 2009: FTC Notice of Proposed Rulemaking on Health Breach Notification RuleCreated by Rodney J. Petersen (EDUCAUSE) on June 25, 2009
The Federal Trade Commission has issued a Notice of Proposed Rulemaking regarding requirements of vendors of personal health records and related entities to notify individuals when the security of their individually identifiable health information is breached. Comments are due on June 1, 2009. The American Recovery and Reinvestment Act (ARRA) of 2009 includes provisions to advance the use of health information technology and, at the same time, strengthen privacy and security protections for health information. Accordingly, the ARRA mandated that the Federal Trade Commission issue rules of health breach notifications. The United States Copyright Office has issued a Notice of Proposed Rulemaking as part of its triennial rulemaking proceeding in accordance with a provision of the Copyright Act which was added by the Digital Millennium Copyright Act and which provides that the Librarian of Congress may exempt certain classes of works from the prohibition against circumvention of technological measures that control access to copyrighted works.
