EDUCAUSE Comments: Telephone Consumer Protection Act Petition to FCC

Abstract

In February 2015, Blackboard Inc. filed a petition with the Federal Communications Commission (FCC) seeking a ruling that auto-text and auto-call messages sent via its Connect mass notification system on behalf of educational institutions would not trigger liability for those institutions or the company under the Telephone Consumer Protection Act (TCPA). EDUCAUSE filed reply comments in support of the argument that educational institutions should not face liability when non-commercial messages sent to mobile phone numbers for which institutions could reasonably assume consent instead reach unintended recipients now holding the numbers in question.
