The following is the essay entry for Tyler Scaff, UNC Chapel Hill, for the James "Rhio" O'Connor Memorial Scholarship Essay competition.
The doctor’s office was the same office I had used for forty-three years: the stuffy air, the crying children in the waiting room, and the pictures on the wall that looked as though those same children had been given fifteen minutes with spray cans and paper. Dr. Arsham, a kind old man with Navajo heritage, had been my physician all of my life. From minor surgery to the mending of broken bone, no medical operation happened to me without first seeking his counsel. It seems only fitting that he would be the one to deliver the news.

A new EDUCAUSE Policy brief from Policy Specialist Joan Cheverie summarizes the long-awaited opinion released May 11, 2012 in the Georgia State University e-reserves copyright infringement case, and provides analysis of what this means for higher ed. The case was a challenge by three academic publishers against Georgia State’s e-reserves policy. The publishers sued in April 2008, claiming that the e-reserves policy went far beyond the bounds of fair use. The brief is now available.

This week, officials from the National Telecommunications and Information Administration (NTIA) emphasized that Federal Agencies will need to share spectrum with commercial carriers in the future. In 2010, NTIA pledged to collaborate with the Federal Communications Commission (FCC) to make 500 MHz of spectrum available by 2020 for mobile and fixed wireless broadband use. Accordingly, NTIA is pushing forward on a new effort that relies on a combination of relocating federal users and sharing spectrum between federal agencies and commercial users. Back in March, I wrote about a first step where NTIA concluded that 95 MHz of prime spectrum could be repurposed for wireless broadband. As states expand efforts to link K-12, postsecondary, and workforce data via state longitudinal data systems (SLDSs), it is important to understand the privacy and security challenges surrounding SLDSs. How the privacy and security approaches of those systems and non-higher education sectors relate to those of higher education (as developed collaboratively through groups such as the Higher Education Information Security Council (HEISC)) is equally relevant. One can get a sense of both by reviewing the resources and information provided by the U.S. Department of Education (ED) Privacy Technical Assistance Center (PTAC).

The U.S. Department of Education's Family Policy Compliance Office (FPCO) oversees instituitonal compliance with the Family Educational Rights and Privacy Act (FERPA). In addition to fielding parent or student complaints about violations of the law and its implementing regulations, FPCO offers a number of resources for institutions, students, and parents to help them understand their respective rights and responsibilities under FERPA. Most recently, FPCO has conducted a series of webinars to provide college and university personnel with a better understanding of the law and how it applies to student records management and data-sharing:

On Wednesday, May 9, 2012, the Senate Judiciary Committee held its third oversight hearing to discuss intellectual property enforcement since the establishment of the Intellectual Property Enforcement Coordinator. The witness before the committee was Victoria A. Espinel, Intellectual Property Enforcement Coordinator. One of the primary roles of this position is to coordinate the work being done across government agencies, including the Department of Justice, the FBI, the Department of Homeland Security, and the U.S. Trade Representative, to combat intellectual property theft.

Just four weeks ago the ELI 2012 Online Spring Focus Session on learning analytics finished. One of the presenters and participants, Christopher Brooks, BSc, MSc of ARIES Laboratory, University of Saskatchewan provided a detailed synthesis of the 2-day session. The ELI 2012 Spring Focus session on learning analytics was an impressive two-day event with 15 speakers and more than 150 participants from around the globe coming together to share experiences on capturing, analyzing, and making sense of student behavior and evaluation data. Presentations were fast and furious, and the activity on the conference Twitter backchannel (#elifocus) provided evidence of the huge amount of energy being expended in higher ed on the topic of learning analytics.
